Unit 2. Legal and ethical issues
To Do List:
|
In Unit 2 You will learn to do the following:
- Understand and discuss legal and ethical issues involved in physical therapy practice in the clinical setting.
- Begin to develop time management skills during your first clinical experience.
1. Legal Issues.
To begin, go to the APTA Center For Integrity In Practice: Reducing Risks webpage at http://www.apta.org/Primer/. The current topic/campaign on this page is Preventing Fraud, Abuse, and Waste: A Primer for Physical Therapists. This campaign focuses on providing physical therapists with information on how to comply with the relevant laws and regulations by identifying risk areas that could lead to potential liability. These issues are important not only for patient care during your clinical internship, but could very well show up on the physical therapy board licensure exam that you must pass to earn your PT license.
Click on the corresponding link on the above mentioned web page to download the Primer in Adobe PDF. Please notice that this Primer is located in another tab within your browser. You will likely need to click back and forth between tabs for the following instructions. It may also be helpful to print this unit instructions or the Primer while completing this task.
Then, read through this Primer booklet. The information that you review in this primer will assist you in completing your first major assignment.
Next, click on the next link under the Accompanying Documents section to download the Primer Presentation. Read through the entire Primer Presentation. This document will also be helpful in completing your Major Assignment 1.
(*Note: you may only be able to access the APTA Primer page with your APTA student or clinician membership. At the time this unit was designed the links were accessible to the public.)

2. Ethical Issues.
Go to the APTA Center For Integrity In Practice: Best Practices webpage at http://www.apta.org/ChoosingWisely/. The current campaign in best practices is Choosing Wisely. This campaign created lists of "Things Providers and Patients Should Question." These lists include evidence-based recommendations that patients and providers should discuss to help make wise decisions about the most appropriate care for that patient, which are ethical concerns and translate to best practices for physical therapists. Again, these may or may not reappear on you PT board license exam.
Next, click on and download the first provided link entitled "5 Things PTs and Patients Should Question". It may be easier for you to complete this assignment if you print the above article. Read through this document thoroughly as this information will be used in completing Major Assignment 1.
Also, download and view the podcast on '5 Things' List and Info at MoveForwardPT.com.
After viewing the podcast, print and review the APTA Code of Ethics for the Physical Therapist.

3. Read Time Management articles.
Your first clinical experience is a great time to begin working on developing your time management skills in clinical practice. Read through the following 2 articles for tips and insight on improving your time management skills. Your improvement in your time management skills will be reflected in your journal that you began in Unit 1, as well as in the assessments that you complete in Major Assignment 4.
Article 1. http://www.mindtools.com/pages/article/time-management-mistakes.htm Article 2. http://www.kent.ac.uk/careers/sk/time.htm *Please note that when you click on the links above that it will take you to a new tab within your browser. You will need to click back on this online course tab in your browser to proceed working on this unit. This applies to all articles and downloads within this online classroom. |
4. Major Assignment 1.
Take a deep breath. You are now about to begin your first Major Assignment. As long as you follow each instruction carefully and submit your work on time, you will do great!
For this first major assignment you will be exploring physical therapy legal and ethical issues by creating a case scenario and completing 2 article reviews. By completing these tasks, you will become more knowledgeable about the current trends in physical therapy legal and ethical practice.
First, using the 2 documents (Primer Booklet and Primer Presentation) that you downloaded in this Unit, select one of the three topics: Fraud, Abuse or Waste. Create your own realistic case scenario that demonstrates a violation of your selected topic without giving the topic away. (The reason that you are instructed not to reveal your topic in your case scenario is because your classmates will be guessing your topic at the completion of your assignment.) Your scenario should be based on the clinical setting where you are currently completing your clinical internship. Your case scenario should remain fairly brief, but should exceed 350 words. Please be as creative as you would like in designing your case scenario, however be sure that your story is as realistic as possible to create an authentic experience for your classmates. You are to post your completed case scenario on our class Facebook Discussion page no later than August 7, 2015. You will be given a total of 40 possible points given that your case scenario meets all the above criteria (realistic scenario, < 350 words, posted by deadline date, applicable to your current clinical setting type). Please refer to the Case Scenario Rubric below for more detail on how you will be assessed for this assignment.
Once you have posted your case scenario to our class Facebook page, you are to comment on the case scenarios of the 3 students that are listed after your name on the alphabetized class list (class list is posted on Blackboard). Should you be one of the last 3 students on the alphabetized class list, you will pick up the names of the people at the beginning of the class list. Please contact me with any questions on which students' scenarios that you are to comment on as I cannot post the class list to this public webpage. Your comment should include your best guess as to which topic the student's case scenario violated (Fraud, Abuse, or Waste) and then briefly comment on what the physical therapist should have done correctly to avoid legal risks. You will gain participation points for posting your comments on your 3 selected students' case scenarios.
Next, using the APTA Code of Ethics and the APTA Choosing Wisely document that you reviewed in the To Do list item #2, select one of the five topics in the Choosing Wisely article to complete 2 article reviews on. The five topics are:
1. Don’t employ passive physical agents except when necessary to facilitate participation in an active treatment program.
2. Don’t prescribe under-dosed strength training programs for older adults. Instead, match the frequency, intensity and duration of exercise to the individual’s abilities and goals.
3. Don’t recommend bed rest following diagnosis of acute deep vein thrombosis (DVT) after the initiation of anti-coagulation therapy, unless significant medical concerns are present.
4. Don’t use continuous passive motion machines for the postoperative management of patients following uncomplicated total knee replacement.
5. Don’t use whirlpools for wound management.
Then, at the bottom of the same Choosing Wisely document you will find a list of sources that correspond to each topic. Choose 2 articles from the list of sources that relate to your selected topic to complete your article reviews. Each article review should contain all of the elements listed in the Article Review Rubric posted below including: the article citation, reference to all of APTA Code of Ethics Principles that the article applies to, summary of the article, and a brief statement on the implication of the information found in this article on the Choosing Wisely campaign or on your own professional practice. You are to type your article reviews in a word processor of your choice and save them in a separate file for each article chosen. Turn in your completed article reviews by emailing me an attachment containing both of your article reviews. You can earn a total of 60 possible points for this assignment, 30 possible points for each article review.
Both portions of this assignment are due by the end of this Unit 2 on August 9th at 11:59pm CST.
